General Guidelines on Copyright Content presented to you as part of the Services, including but not limited to advertisements in the Services and sponsored Content within the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content through the Services (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on such Content that you do not own unless you have been explicitly granted a license to do so by the owner of that Content, in a separate agreement.

You understand that by using the Services you may be exposed to Content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk. The Company shall have the right, but not the obligation, to remove any Content that is violative of any law, regulation or guideline, or that it deems offensive, in its sole discretion.

With respect to any Content that you have submitted to the Site, you have the right to request the Company remove such Content, thus revoking any rights the Company has with respect to such Content. Requests of this kind are to be submitted to info@sewist.com. Sewing Patterns A sewing pattern is copyrighter by its creator, including all parts like cover photo, technical drawing, instructions et cetera.

Users can only upload the mentioned information to the pattern listings that illustrate their own designs.

It is prohibited to upload scanned layouts of pattern blocks, illustrations of the sewing process, written instructions as provided by the publisher, including description of the sewing process or formulas for drafting a pattern for scratch, for patterns that you have not designed yourself to any part of the website where they might become accessible to other users, including but not limited to user and group avatars, project photos, forum posts, jobs, et cetera.

You are welcome to add patterns to the Sewist database so that they can then be stored in yours and others libraries. You can mention comprehensive pattern information such as name, size, fabric requirements, sizes and tags, just not parts of the original copyrighted work. You are also welcome to add reviews on sewing patterns and create projects, as well as add images of your finished garments.

Notice on visual information

Certain Content which belongs to another rights holder may be uploaded under the “fair dealing” or “fair use” exceptions to copyright law. These exceptions broadly allow persons to distribute copyrighted material without first obtaining the right-holder’s permission for certain limited purposes such as criticism, private study, or research. Please note that it is entirely Your responsibility to ensure that such Content complies with these exceptions and We do not monitor Content to ensure it complies with such exceptions. Uploading pattern visual information is only allowed along with providing a link back to the publisher’s page and is only acceptable provided the image meets both the legal criteria for fair use (not infringing commercial interests of the publisher, for educational, commentary and critical purposes only, thumbnail-size images linking back to the official publisher).

If you are unsure whether certain Content qualifies under the “fair dealing” or “fair use” exceptions, you should either ask the owner for permission to use it, or otherwise not use it at all. You agree to indemnify and hold Us harmless from any claim related to uploaded Content that does not meet the “fair dealing” or “fair use” exceptions.

Examples of Content you likely do not have the right to submit due to potential infringement on the copyright of third parties include:
  • A photograph depicting a person who has not given You permission to post their photo.
  • An image or text that belongs to another person or company and is not being posted under the terms of “Fair use” or with their explicit permission.
  • Any PDFs or other documents or files that You did not create, You do not own, is not from a company You work for, and You do not have explicit permission to submit, for example someone else’s digital PDF pattern.
  • Written instructions for a pattern that You did not create and do not have the rights or explicit permission to post (small excerpts are usually permitted, like with any text document).
To prevent possibility of using pattern library for infringing copyrighted content, Sewist is taking extra measures and further processes uploaded images for low-resolution standards, including, but not limited to pixel and spatial resolution effects, and serves as a non-profit search engine promoting all sewing patterns in the market equally.

Sewist members are given the opportunity to flag any image as infringing copyright and in such a case, the image will be taken down immediately.

Printed patterns, or books, or magazines are your property that you can list in your online store and swap or sell to other users, provided that you ship the printed original material and not copies/scans of it. The photos should clearly illustrate the state of the item if it is intended for swap or sale. Magazine Covers In case of a magazine cover, the copyright for it is held by either the publisher of the magazine or the individual contributors who worked on the cover depicted.

Sewist uses low-resolution images of magazine covers to illustrate the publication of the issue of the magazine in question. The described use of low-res images for illustrative, educational and reference purposes qualifies as fair use under Paris Convention for the Protection of Industrial Property and United States copyright law. Any other uses of these images, on Sewist or elsewhere, may be copyright infringement.

As a further step to prevent these images from being used in ways that might infringe the publisher's and the artists copyright, all magazine covers have been resized to a maximum of 150 px and are always accompanied with links to the publisher or the pattern/book/magazine page online. It is believed that the users who have the mentioned issues in their possession will still be able to get oriented in their libraries. The original images are not stored on Sewist servers.

It is prohibited to upload magazine cover images to any part of the website where they might become accessible to other users, including but not limited to user and group avatars, project photos, forum posts, et cetera.

Sewist members are given the opportunity to flag any image as infringing copyright and in such a case, the image will be taken down immediately.

If you are a publisher, and would like your magazines to be listed on Sewist with more representative images to inspire interest among sewing community and drive more business to your brand, kindly send us an e-mail with a written permission to update the cover images.
